Terms of use
These terms are the agreement between you and [CONTROLLER NAME] (“Phyler”, “we”, “us”) for using the Phyler apps, currently Phyler - Fish. By creating an account you agree to them. Please also read our Privacy policy, which explains how we handle your data.
Who can use Phyler
You must be 13 or over to use Phyler. Some features also depend on age (see Children and young people in the Privacy policy):
- If you are under 15, social features (following, groups and the feed) are not available.
- If you are 15 to 17, your account is always private.
You must give your real date of birth. We may suspend an account we believe was set up with a false age.
Your account
You sign in with Google or Apple. Keep that account secure, because anything done through your Phyler account is your responsibility. Tell us at support@phylerapp.com if you think someone else has accessed it.
Your content
Your photos, catches, posts and comments stay yours. So that we can run the app, you give us a non-exclusive, worldwide, royalty-free licence to store, process and display your content, and to show what you choose to share to the audience you choose. This licence ends when you delete the content or your account, except for copies other people have already legitimately saved, and backups kept for a short time.
If you are 13 or over, you also allow us to use your catch photos to improve Phyler’s species identification, as described in the Privacy policy. You can object to this at any time, as explained there.
Only post content you have the right to share.
Acceptable use
Don’t use Phyler to:
- post anything illegal, harmful, hateful, sexual, violent or bullying
- impersonate someone, or mislead people about who you are
- share other people’s personal information without their permission
- post content that has nothing to do with the app’s purpose (spam, advertising)
- interfere with the app, try to get around its limits, or access it by automated means
Shared posts are checked automatically before other people can see them, and we can remove content or suspend accounts that break these rules. You can report anything that worries you to support@phylerapp.com.
AI results are estimates
Species identification and length estimates come from AI and can be wrong. Don’t rely on them for anything that matters, including:
- legal size limits, bag limits, or protected-species rules. Always check the rules for the water you fish.
- whether a fish is safe to eat.
You can correct the species and length before saving a catch.
AI limits and credits
Each account tier includes a daily number of AI identifications. AI credits, where we give them, let you go past that limit. Credits have no cash value, can’t be transferred or exchanged, and may be withdrawn if they were obtained by misusing the app. Daily limits and credit amounts may change.
Paid plans
Phyler doesn’t sell subscriptions yet. Before it does, we’ll update these terms to cover pricing, renewal, cancellation and refunds.
Ending your account
You can delete your account at any time (see Delete your account). We may suspend or close an account that seriously or repeatedly breaks these terms. Where we reasonably can, we’ll tell you why.
Changes to Phyler and these terms
We may change features, or change these terms. If a change to these terms is significant, we’ll let you know before it takes effect. If you keep using Phyler after that, you accept the new terms.
Our responsibility to you
We provide Phyler with reasonable care and skill, but we can’t promise it will always be available or error-free. We aren’t responsible for losses that weren’t foreseeable, or for losses caused by your use of AI results (see AI results are estimates). Nothing in these terms limits liability that can’t be limited by law, such as for death or personal injury caused by negligence, or for fraud, and nothing affects your legal rights as a consumer.
Law
These terms are governed by the law of England and Wales. If you live elsewhere in the UK, you can also bring a claim in your local courts.
